Privacy Policy & Professional Confidentiality Notice
Professional duties under Section 132 Bharatiya Sakshya Adhiniyam, 2023 & Technical Practices
1. Advocate-Client Professional Communications Protection
Under Indian law, professional communications between an advocate and a formally engaged client are protected under Section 132 of the Bharatiya Sakshya Adhiniyam, 2023 (BSA), which corresponds to Section 126 of the repealed Indian Evidence Act, 1872.
In accordance with Section 132 BSA, an advocate is prohibited, without the express consent of their client, from disclosing any communication made to them in the course and for the purpose of their employment as an advocate, or stating the contents or condition of documents with which they have become acquainted in the course and purpose of such employment, or disclosing any legal advice given by them to their client.
Statutory Exceptions (Proviso to Section 132 BSA):
- Any communication made in furtherance of any illegal purpose; or
- Any fact observed by an advocate showing that any crime or fraud has been committed since the commencement of employment.
Preliminary Communications: Unsolicited or preliminary communications sent via email or telephone prior to the formal acceptance of professional engagement and execution of a Vakalatnama do not automatically create an advocate-client relationship or attract statutory privilege under Section 132 BSA.
2. Website Architecture & Multi-Tier Data Processing Disclosure
To ensure transparency and factual accuracy, data processing is categorized across distinct operational tiers:
- Application-Level Data Collection (Zero): The website application maintains zero databases, zero user registration accounts, and zero automated data capture endpoints. No public forms collect personal case histories, FIR details, or confidential briefs.
- Browser Storage (Functional Only): A single browser local storage key (
bci_disclaimer_accepted_v1) records that the user has acknowledged the mandatory Bar Council of India disclaimer modal, preventing repetitive popups. No personal identifiers or analytics tokens are stored. - Hosting Infrastructure & Edge Routing: The website is statically hosted on Cloudflare Pages. Cloudflare edge servers may record standard technical server request logs (such as connecting IP addresses and browser user-agent headers) strictly for operational security, DDoS mitigation, and traffic routing.
- Font Assets Delivery: Typography stylesheets and font files are loaded from Google Fonts CDN (Google LLC). Browser requests for font assets convey standard HTTP request headers (IP address and User-Agent) necessary for network delivery. No tracking cookies are set by font requests.
- Voluntary Professional Communications: Any communication initiated by a visitor through telephonic call or direct electronic mail is received directly by chamber personnel. Such correspondence is handled manually and subject to mandatory conflict-of-interest checks before formal acceptance of engagement.
3. Absence of Commercial Tracking & Third-Party Analytics
This website operates with strict privacy-by-design principles:
- No advertising cookies, behavioral tracking pixels, or commercial retargeting scripts (such as Facebook Pixel or Google Ads).
- No third-party analytics fingerprinting or behavioral tracking scripts.
- No selling, renting, licensing, or commercial sharing of visitor contact information with any commercial entity.
4. Data Protection Legislation Framework (DPDP Act, 2023)
Data handling practices are guided by Indian data protection legislation, specifically the Digital Personal Data Protection Act, 2023 (Act No. 22 of 2023).
Establishment of the Data Protection Board of India: The Central Government formally established the Data Protection Board of India pursuant to Section 18 of the Digital Personal Data Protection Act, 2023 via Ministry of Electronics and Information Technology (MeitY) Notification G.S.R. 844(E) dated 13 November 2025 (published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i)).
Phased Statutory Commencement Roadmap: The Act operates under a phased implementation model under Section 1(2):
- 13 November 2025: Formal establishment and constitution of the Data Protection Board of India under Section 18 (Notification G.S.R. 844(E)).
- 13 November 2026: Scheduled commencement milestone for substantive core data fiduciary obligations, statutory notice protocols, and primary compliance procedures under appointed provisions and rules.
- 13 May 2027: Extended transitional milestone for advanced systemic compliance, complex technical architecture standards, and full regulatory audit mandates.
Operative Status Note (October 2026): While the Data Protection Board of India is legally established under Section 18, substantive data fiduciary compliance obligations and procedural enforcement rules are rolling out across the Central Government's phased commencement schedule. The website maintains an architecture of zero digital personal data collection, zero registration forms, and zero tracking pixels, satisfying the core statutory principle of data minimization by design.
